SimScale Privacy Policy

This Privacy Policy governs the use of the websites of SimScale GmbH (“SimScale”) such as, including any related services offered on such websites (collectively, “Websites”). This Privacy Policy gives details of which information is collected by and provided to SimScale, how SimScale may use such information and whether such information constitutes personally identifiable information (“Personal Data”).

SimScale is committed to protecting the privacy of individuals who visit the Websites and of individuals who register to use the services offered on the Websites (collectively, “User(s)”).

1. Account Creation

Upon account creation on the Websites, SimScale collects certain Personal Data about the User including first name, last name, email address, phone number, password, and billing data, where required. SimScale uses this Personal Data to set up the User’s account (“Account”), to provide services via the Websites, and to allow administration and communication with the User regarding the User’s account.

2. Visiting the Websites

When the User visits the Websites, SimScale collects certain information to ensure usability and optimization of the Websites, their technical administration as well as system security and stability. SimScale particularly collects IP addresses, geolocation, information on browser type and browser version, browser plug-ins, operating system, the referring URL and the date and duration of visit. Furthermore, SimScale collects information which the User submits to SimScale via the Websites and/or generates while using services offered on the Websites. SimScale may relate the collected information to an individual User if User visits the Websites through an Account or submits to SimScale identifiable information. Where any of the collected information constitutes Personal Data, SimScale may collect such Personal Data to enable the User’s use of the Websites and to rectify errors and to fix bugs in connection therewith (the “Purpose”).

To facilitate the Purpose, SimScale may share Personal Data with third-party service providers such as email service and analytics providers, data storage and processing facilities, in order for those service providers to perform business functions solely for SimScale or on behalf of SimScale.

The Websites use cookies. Cookies are small files placed locally on the User’s Internet access device which enable SimScale to measure the overall navigation on the Websites and which allow SimScale to improve the usability of the Websites. Some cookies enable SimScale to recognize related requests of a particular User and automatically expire at the end of each session or after a certain period of inactivity (session cookies). Other cookies enable SimScale to recognize the User’s Internet access device the next time such User accesses the Websites and remain on the User’s device after the end of a session (permanent cookies). The cookies used by SimScale do not contain and will not be connected to data which would allow for the User’s identification except where the User visits the Websites through an Account or submits to SimScale identifiable information. The placement of cookies can be deactivated within the browser settings of the User’s Internet access device. If the placements of cookies is deactivated, some features of the Websites will possibly not be available anymore.

The Websites use the analytics service Google Analytics provided by Google Inc. Google Analytics is based on cookies and enables SimScale to analyze the usage of the Websites. The information generated is usually transmitted to a Google server in the USA. As “IP anonymization” is activated for the Websites, any collected IP address will be truncated and thereby anonymized by Google within Member States of the European Union or within Member States of the Agreement on the European Economic Area before their transmission to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and be truncated there. Google will use this information on SimScale’s behalf to analyze the use of the Websites, to compile reports on website activity and to provide services to SimScale related to the use of the Internet or the Websites. The IP address transmitted by a browser in the context of Google Analytics will not be merged with other data of Google. The placement of cookies can be deactivated by selecting the appropriate browser settings. If the placements of cookies is deactivated, some features of the Websites will possibly not be available anymore. Transmission of the data generated by the cookie and relating to the usage of the Websites (including your IP address) to Google as well as the processing of such data by Google in connection with Google Analytics can be prevented by downloading and installing the opt-out browser plug-in made available by Google.

SimScale is not responsible for the information the User discloses to SimScale or to other Users and for the User’s compliance with applicable laws while using the Websites.

3. Emails

SimScale will use information collected during Account creation and User’s use of the Websites to send to the User regular emails which may contain service related announcements and customized information about SimScale’s offerings and/or offerings of partners of SimScale. Such information is processed by a service provider acting on SimScale’s behalf. Such service provider may also place a pixel tag within the emails which helps SimScale to recognize whether an email has been opened by the User. User may revoke its consent to receive any such emails from SimScale at any time by contacting SimScale directly via the contact information as specified under 5. below.

4. Non-Disclosure of Personal Data

SimScale will not sell, license, rent or trade User’s Personal Data. SimScale will not otherwise disclose the User’s Personal Data except as described within this Privacy Policy.

SimScale may disclose the information SimScale receives if required by law, such as to comply with statutory law, a subpoena, or similar legal process or response to a government request.

5. Contact Information and Data Subject Rights

User may revoke its consent to the processing of its Personal Data at any time.
