This Privacy Policy governs the use of the websites of SimScale GmbH (“SimScale”) such as simscale.com, including any related services offered on such websites (collectively, “Websites”). This Privacy Policy gives details of which information is collected by and provided to SimScale, how SimScale may use such information and whether such information constitutes personally identifiable information (“Personal Data”).

When visiting our home page, we consider it as very important to protect your personal data when collecting, processing and using it. We use the common SSL (Secure Socket Layer) method in connection with the highest level of encryption supported by your browser. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can see whether an individual page of our website is transmitted in encrypted form by the representation of the closed bowl or lock symbol or by the use of “https” in front of the address of our (sub)website. We also use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties. Our security measures are continuously improved in accordance with technological development.

If you have not consented to the data transfer, if the data transfer does not serve the fulfillment of the contract or if the transfer is necessary for the assertion, exercise or defense of legal claims, the data are only transferred by us if there are suitable safeguards or an adequacy decision. 

A suitable safeguard exists, for example, if the EU standard contractual clauses issued by the EU Commission have been concluded.

Specific privacy information for data processing operations on the website.

1. When visiting the website 

When visiting our website, the browser used on your terminal device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. 2. When using our contact form

You can pose questions of any kind through our contact form which is available on our website. The indication of your valid email address and your name is required enabling us to trace the sender of the enquiry and to respond to it. Further information can be provided voluntarily.

Data processing for the purpose of entering into contact with us is made pursuant to Art. 6 seq. 1 sent. 1 lit. a GDPR and is based on your voluntarily given consent. The personal data collected by us for the use of the contact form will be automatically erased after you have completed your request.

If your request is directed to the conclusion of a contract, Art. 6 seq. 1 sent. 1 lit. b) GDPR serves as the legal basis. In this case, we store your data for the duration of the statutory retention periods. 

3. When registering for our newsletter

If you have expressly consented in accordance with Art. 6 seq. 1 sent. 1 lit. a GDPR, we will use your email address to send you our newsletter regularly. 

To receive the newsletter, it is sufficient to provide an email address. Cancellation is possible at any time, for example via a link at the end of each newsletter. Alternatively, you can also send your cancellation to mail@simscale.com by email at any time.

We store your data until the revocation of your consent.

HubSpot

We use the services of HubSpot, Inc (25 First Street, Cambridge, MA 02141 USA) for sending our newsletter. 

HubSpot is a service to organize and analyze the mailing of newsletters. If you enter data for the purpose of subscribing to the newsletter (e.g. e-mail address), this data is stored on the servers of HubSpot in the USA.

We have concluded a data processing agreement with HubSpot, Inc. and the EU Standard Contractual Clauses. The data may therefore only be processed by the provider according to our instructions for the purposes described here. The provider does not process the data for his own purposes.

With the help of HubSpot, we can analyze our newsletter campaigns. When you open an e-mail sent with HubSpot, a file contained in the e-mail (so-called web-beacon) connects to the servers of HubSpot in the USA. In this way, it can be determined whether a newsletter message has been opened and which links have been clicked on. Furthermore, technical information is collected (e.g. time of retrieval, IP address, browser type, and operating system). This information can be assigned to the respective newsletter recipient. It is used for statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you do not want to receive any analysis by HubSpot, you have to unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message. 

The data processing is based on your consent (Art. 6 para. 1 lit. a DSGVO). You can withdraw this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data that you provide us with for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from the servers of HubSpot after the cancellation of the newsletter.

4. When registering for our webinars/workshops

On our website, you have the possibility to register for our webinars and workshops. In the form, the data required for the fulfillment of the contract are requested. The additional data marked as “optional” can be entered by you voluntarily. If you provide this data, we will also use it to contact you in the course of fulfilling the contract.

If you consent to receiving our news and updates, please refer to the relevant section in this privacy policy (see Nr. 3).

The legal basis for processing your data is Art. 6 para. 1 p. 1 lit. a), b) GDPR.

As a matter of principle, we delete your data when they are no longer required for the fulfillment of the contract. Thereafter, we delete the data immediately, unless we are required to retain it by law or need the data for evidentiary purposes for civil claims. If you have consented to receive our news and updates, please note the retention periods in the relevant section (see Nr. 3) of this privacy policy.

5. When requesting pricing information

When you are interested in our subscription plan for your or your team you have the option to request the pricing via the form on our website. To answer your request we need your name, your email address, your phone number, and details about your company and your interest and experience. 

If you consent to receiving our news and updates, please refer to the relevant section in this privacy policy (see Nr. 3).

As the requests by this form are directed to the conclusion of a contract, Art. 6 seq. 1 sent. 1 lit. b) GDPR serves as the legal basis. We store your data for the duration of the statutory retention periods. 

6. When downloading our white papers

You have the possibility to download whitepapers via our website. This requires you to enter your email address, name, phone number, and interest. You can provide information about the company voluntarily. 

After submitting your data, you will receive an e-mail with a link to download the whitepaper. By submitting the form, you agree that we may contact you by phone to introduce you to our products. In addition, we will send you news and updates by e-mail if you have expressed this wish in the form (please refer to our notes on the newsletter in this privacy policy under No. 3).  Finally, we also process the information for statistical purposes in order to be able to identify which interest groups download the white papers. 

The legal basis for processing your data is your consent, Art. 6 seq. 1 sent. 1 lit. a GDPR. 

Unsubscribing from our news and updates is possible at any time, for example via a link at the end of each newsletter. Alternatively, you can withdraw your consent at any time by expressing this wish in the telephone call with our employee or by sending an e-mail with the corresponding request to mail@simscale.com.

We will store your data until you withdraw your consent.

Providing your consent is voluntary. We cannot provide you with our whitepaper without your consent.

7. Registration for a SimScale Account

To use our simulation tool or to become part of our community it is necessary to create an account. 

Depending on the subscription plan, the use is free or paid. 

To create an account, it is necessary to register with your name, email address, phone number, and password. 

In the case of a paid account, additional billing and payment information is required.

We need this data to initiate or fulfill the usage contract with you. The legal basis is therefore Art. 6 seq. 1 sent. 1 lit. b GDPR.

As a registered user, you can provide additional information in your public community profile. This information is voluntary and may be visible to visitors of our website.

The legal basis for the processing of this data is Art. 6 seq. 1 sent. 1 lit. a GDPR.

We process the data for the duration of the contractual relationship and beyond that for the duration of statutory retention periods. We store your voluntarily provided data until the withdrawal of your consent.

8. When actively participating in the community

As a registered user, you have the possibility to participate in our community. You can publish, like or comment on “Public Projects” and participate in the discussions in the forum. Your contributions are then published with your username, your profile picture, and, if applicable, further information from your public user profile for all users of the website. By using these functions, you agree to this. The legal basis is your consent pursuant to Art. 6 seq. 1 sent. 1 lit. a GDPR. 

The data will be stored until you withdraw your consent.

9. Application Process

It is particularly important to us to ensure the highest possible protection of your personal data. All personal data collected and processed as part of an application are protected against unauthorized access and manipulation by technical and organizational measures. 

We need your personal data in the application documents in order to consider you as an applicant in the application process and to check whether you can be considered as an employee of our company. If you provide information that goes beyond this required information, you are providing it to us voluntarily and agree to its processing.

The legal bases for the processing are thus Art. 6 seq. 1 sent. 1 lit. a and b GDPR, § 26 seq. 1 sent. 1 BDSG. The withdrawal of the consent is possible at any time. You can send your withdrawal at any time to mail@simscale.com by e-mail.

After completion of the application process, we will store your documents for another three months for evidence purposes. 

For a possible conclusion of a contract, it is necessary that you provide us with your personal data in the application documents. Otherwise, we will not be able to consider you in the application process.

We use the HR-tool greenhouse of Greenhouse Software, Inc. (18 West 18th Street, 11th Floor, New York, NY 10011 USA) in the application process. We have concluded a data processing agreement for this purpose. Therefore, Greenhouse Software, Inc. may only process the data according to our instructions and not for its own purposes. We have also entered into the European Commission’s standard contractual clauses with Greenhouse Software, Inc.

10.  Cookies, analysis tools, plugins, and other elements of third parties  

We use cookies on our site. These are small files that your browser automatically creates, and which are stored on your terminal device (laptop, tablet, smartphone, etc.). Cookies do not harm your terminal device and do not contain viruses, trojans or other malware. The cookie is used to store information that arises in connection with the specific terminal device used. However, this does not mean that we will immediately become aware of your identity.  

Analysis tools are used to evaluate the behavior of the website visitors and enable the provider to optimize the website and adapt marketing measures. 

Plugins and other elements from third parties are used to integrate the content of these providers into the website.

a) Required first-party cookies

The use of our necessary first-party cookies serves on the one hand to make the use of our range more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages on our website. These are automatically erased after leaving our site. 

In addition, we also use temporary cookies to optimize user-friendliness, which is stored on your terminal device for a certain period of time. If you visit our site again in order to use our services, it automatically recognizes that you have already visited us and which entries and settings you have made so that you do not have to enter them again. 

These data will be erased after 6 months at the latest.

We process your data on the basis of our legitimate interest in the external presentation of our company via the website you have called up and to promote user-friendliness. The legal basis for the processing is Art. 6 seq. 1 sent. 1 lit. f GDPR.

Most browsers automatically accept these cookies. However, you can configure your browser so that no cookies are stored on your computer or a message always appears before such a cookie is generated. However, if cookies are completely deactivated, the website may not be displayed correctly, or you may not be able to use all the functions of our website.

The following indicated and used third-party cookies, analysis tools, plugins, and elements of third parties are used only after receipt of your expressly given consent based on Art. 6 seq. 1 sent. 1 lit. a) GDPR. You can withdraw your given consents here at any time in the future. The withdraw of your consent or not giving your consent may lead to an incorrect display of the website or the website does not allow to use of all functions.  

With the Third-Party-Cookies analysis tools, plugins, and other elements of third parties we want to ensure a need-based design, marketing measures, and the continuous optimization of our website. In addition, we use the tracking measures in order to statistically record the use of our website and evaluate it for the purpose of optimizing our services for you. 

The respective functional descriptions, possible recipients of the data, information on possible transfers to a third country, and the storage duration can be found in the following notes on the individual processing steps with third-party cookies, analysis tools, plug-ins, and other third-party elements.

a) Google Analytics

We use Google Analytics, a web analysis service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; referred to in the following as “Google”), to design our website in line with needs and to optimize our sites on an ongoing basis. In this connection, pseudonymized usage profiles are produced and cookies are used. Information on your use of this website generated by the cookie such as

b) Intercom

Intercom is an administrative service for user databases of Intercom Inc. In order to optimize the customer service, to answer the upcoming queries as quickly as possible, to prepare payments, to control unauthorized use, to analyze trends, and to prepare advertisements, Intercom is activated when the data subject is in the log in area. A limited part of the data (e.g. name, email address, phone number, abode, photos, and time of registration) is submitted to Intercom Inc. (98 Battery Street, Suite 402, San Francisco, CA 94111 USA). In order to extend the comprehension about our customer, publicly available information (e.g. the company of a customer, professional designation, physical address, website, or social networks) is collected. Additionally, cookies are used to generate an analysis of user behavior. The collected information of the cookies is stored on a server in the USA. This information serves as a usage assessment of the platform and to optimize our products.

c) Quora

Quora is a free-of-charge knowledge platform of Quora Inc., which tries to give answers to any possible question placed by our customers. Cookies are used. They enable us to remember logged-in users, to understand how users navigate through the Quora platform and how they use it and to display personalized content and targeted advertisements (including websites and applications of third-party providers). Additionally, browser information such as IP address, location, date stamp and timestamp, Quora cookies ID, URL, clear identifications of advertisements or contents, time zones, and other information about user activities are collected. In order to identify errors in JavaScript within our web application, we use Track.js of TrackJS LLC. This program offers an error tracking service in order to identify errors and bugs early before they are signaled. HeatMap Inc. offers a SaaS-Tool to analyze and display the online behavior of website visitors. By the combination of analyzing tools and visual Heatmap presentations, HeatMap helps its customers to understand, how to improve the user experience, the performance, and the conversation of their website. Mouse and touch activities (but no keyboard activities), the screen size of the used device, the geographic abode of the website visitor (only the country), the visited sites, the date and time, when the websites were accessed are analyzed and retraced. Cookies are used to collect information such as log-in data and browsing activities. The data are stored on different servers within and outside the EU. In general, the data are stored maximally up to the expiry of the retention obligation, otherwise, a premature deletion is made after the final processing. In order to conveniently share the contents of our site with our users through social networks, we use AddToAny. This is a bookmark and share button program. No personal data are sent to social networks, personal data are collected only when the person itself visits these social networks and logs in (being subject to the respective privacy statements). For this reason, no transfer of personal data is made when AddtoAny is used. Only log information is collected from the technical server and stored for 30 days. There is the possibility to opt-out avoiding that data about the surfing behavior are transmitted.

This homepage uses the Avatar-Service which is supported by Gravatar being operated by Automattic, Inc. 132 Hawthorne Street San Francisco, CA 94107, USA. Gravatar serves to uniquely generate an Avatar image that follows the generator to all Gravatar-enabled websites and can be further used. We use Gravatar to provide and develop our services and to solve service problems. Therefore the encrypted email address is transferred in order to identify linked user images and to have the respective user image displayed. If the image is displayed the IP address of the respective Gravatar user can be identified and stored for 30 days. Our website is hosted by WPEngine Inc., 504 Lavaca Street, Suite 1000 Austin, Texas 78701. WPEngine only provides the webserver platform. Personal data such as contact information or names are enquired in order to use all functions of the website. User information and technical data are identified by means of cookies. The user behavior is analyzed in order to assess trends and user behavior on the website and to generate information about the user basis. Furthermore, the IP address, browser type, and the internet service provider are stored. The storage of these data is made according to the maximum period of time allowed by law. The purpose of the storage is to secure the use and interaction with the homepage as well as to obtain continuous information on the development of the homepage and transfer of marketing information of the services used. j) DoubleClick

In order to optimize our homepage, we use DoubleClick, a service of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter „Google”). DoubleClick offers online marketing solutions which enable to display of tailor-made advertisements. Cookies observing the user behavior with regard to switches from one website to another and displayed and clicked advertisements are used. This requires that technical data such as IP address, domain, browser, local time, operating system, and view of sites are stored. The collected data are transmitted to a server in the USA and stored. Google uses the gained data for the statistical assessment of user behavior in connection with the advertisements placed by DoubleClick. k) Hotjar

In order to improve our website, we use Hotjar, a service of Hotjar Ltd. (Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe; hereinafter „hotjar“). Hotjar analyses user trends, assist in determining technical problems, and allows offering a better service. Hotjar helps us to make our website more user-friendly and to make the site easily operable. We, therefore, make use of cookies and tracking codes. For this reason, technical data are stored such as the IP address of your device (collected and stored in an anonymized format), your email address including your first name and your family name, as far as you put them at our disposal through our website, screen size of your device, type of device and browser information, geographic abode (only the country), the preferred language in order to display our website.

Furthermore, Hotjar generates the following log data on our server: referring domain, visited sites, geographic abode (only the country), the preferred language in order to display our website, date and time of access to our website. In order to render these services, Hotjar also makes use of third companies’ services (e.g. Google Analytics, Optimizely). Information sent in form of cookies or IP requests by your browser during your visit to our website is stored. The data collected by Hotjar are transferred to a server in Europe and are stored there. We use the Facebook Pixel of Facebook, Inc. (1601 Willow Road, Menlo Park, California 94025, USA). This allows us to track conversions, retarget website visitors, and gain additional information about members who view advertisements. We use your personal data to show you advertisements that are of interest to you and thus make our website more interesting for you.

The Facebook pixel allows us to collect data about visits to this website, including URL, referrer URL, IP address, device and browser properties (user agent), and timestamps. 

Facebook does not share any personally identifiable information with us, but only provides aggregated reports about website audience and ad performance. Facebook also provides retargeting for website visitors, so we can use this data to display targeted ads outside of our website without identifying the member.

On our website, we use the LinkedIn Insights Tag of LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland (“LinkedIn”) for so-called conversion tracking. The LinkedIn Insights Tag analyses information about the user’s surfing behavior (in a particular IP address, timestamp, websites visited, link to LinkedIn profile) and transmits it to LinkedIn. In particular, it is also analyzed through which LinkedIn ads or posts you have accessed our website. Through this information, the ads on LinkedIn and our website can be optimized.

To evaluate the use of our website, we use the service of the provider HubSpot, Inc. (25 First Street, 2nd Floor, Cambridge, MA 02141 USA).

HubSpot evaluates the information collected (e.g. IP address, geographical location, type of browser, data entered in contact forms, duration of the visit, and pages viewed) on behalf of SimScale in order to generate reports.

If a user subscribes to the newsletter (see no. 3) or obtains downloads of our whitepapers (no 6), we can use HubSpot to link a user’s visits to www.simscale.com with personal information (especially name/email address) on the basis of consent given, thus recording personal information and informing users individually and specifically about preferred topics.
